How overtime pay works in the United States
Under the federal Fair Labor Standards Act, non-exempt employees must be paid at least 1.5 times their regular rate ("time and a half") for every hour over 40 in a workweek. Some states go further: California requires time and a half after 8 hours in a day and double time after 12 hours in a day or after 8 hours on the seventh consecutive day; Alaska, Nevada and Colorado also have daily overtime rules.
Overtime formula
Overtime pay = Overtime hours × Regular rate × 1.5. For a $20/hour worker with 48 hours: 40 × $20 = $800 regular + 8 × $30 = $240 overtime = $1,040 for the week.
Who is exempt from overtime?
Salaried employees in executive, administrative, professional, outside-sales and some computer roles who earn above the federal salary threshold are exempt. Most hourly workers are non-exempt and must receive overtime.
Is overtime taxed more?
Overtime is taxed like any other wages. A bigger paycheck can have more tax withheld in that pay period, but your actual annual tax depends on total income – you do not pay a special higher rate on overtime.
